We have heard learned counsel for the petitioner.
The petitioner has been externed under the U.P. Control of Goondas Act, on the ground that there are two cases of murder, one of attempt to murder, one under the Arms Act and one under the Gangsters Act against the petitioner. Against that order, the petitioner filed an appeal.
Learned counsel for the petitioner has argued that the wife of the petitioner is contesting an election and, therefore, petitioner's assistance particularly with the background mentioned above, is essential to that election and, therefore, an interim stay should be granted by this Court during the pendency of appeal before the learned Commissioner.
We are of the opinion that writ petitions are not maintainable purely for obtaining interim orders. Therefore, we direct the learned Commissioner, Meerut Division, to dispose of the petitioner's appeal as early as possible.
The writ petition is disposed of as above.
