The petitioner's case is that a sale deed was executed by Mithai Lal respondent in her favour and on the basis of the sale deed a compromise was entered into between the parties before the Assistant Consolidation Officer and her name was mutated and against that order a time barred appeal was filed by Mithai Lal and the Settlement Officer Consolidation has allowed the appeal and has remanded the case to the Consolidation Officer for a fresh decision. The revision against the order of the Settlement Officer Consolidation has been dismissed by the Deputy Director Consolidation. It is submitted by the petitioner's counsel that there is a registered sale deed in her favour executed by the respondent. The respondent had denied the execution of the sale deed and also alleged that he never entered into any compromise. The finding of fact of the Settlement Officer Consolidation is that the Istahar itself appears to be doubtful. The case has been remanded to the Consolidation Officer. It is open to the parties to put forth their version before the Consolidation Officer who will decide the case in accordance with law.
No ground for interference has been made out. Dismissed.
