This application can not be held maintainable in view of the fact that no refusal has formally been made by the court below. We can not pass any order only on the basis of submission of the learned Counsel appearing for the appellant-applicant. However, the appellant is at liberty to make application in the court below for the purpose of withdrawal of the amount in terms of the order dated 12th May, 2004.

With the above observation, the application is disposed of without imposing any cost.
