Criminal Appeal No. 57 of 2007 has been filed by Babu Ram, Sita Ram, Dinesh and Dev against the judgment and order dated 21.12.2006 passed by Addl. Sessions Judge, F.T.C. No. 1, Moradabad in S. T. No. 1165 of 1999 whereby the appellants have been found guilty and convicted under Section 307/34 IPC and have been sentenced to undergo rigorous  imprisonment for seven years and fine has also been imposed on them.

Criminal Appeal No. 8063 of 2006 has been filed by Chanchal, Chhattara, Naraina, Khajan, Vijay, Hukum Singh and Gulab against the judgement and order dated 21.12.2006 passed by same court in S. T. No. 1044 of 2003 whereby the appellants have been found guilty and convicted under Sections 147, 307/149, 148, 506(2) IPC and have been sentenced to undergo rigorous imprisonment up to seven years and fine has also been imposed on them with default stipulation. These two appeals arise out of the two cross cases and therefore it be connected together.

Heard learned counsel for the parties and perused the impugned judgement.


In the circumstances of the case, appellants shall continue on bail, during pendency of this appeal, on their furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.

The realisation of fine as against the appellants shall remain stayed during pendency of this appeal. They shall shall also furnish an undertaking that they will not indulge in any criminal or anti social activity and if any report is found against them it shall be open for the court below to report to this court so that their bail may be cancelled.
