This writ petition has been filed under the apprehension that Respondent no.4 is being selected for the dealership of Kisan Sewa Kendra. Though, the petitioner claimed to be a number one of the merit list prepared by the Selection Board.
Sri Sanjiv Singh, learned counsel appearing for the respondent nos. 2 and 3 submitted that after investigation no such decision has yet been passed and complaint has been received regarding the preparation of the merit list and if any adverse order is passed against the petitioner she will be heard before passing any final order. Therefore, it is suggested by Sri Sanjiv Singh that there is no occasion for this Court to pass any order at such a preliminary stage.
After hearing the learned counsel for the parties, we dispose of the writ petition being pre-mature in view of the statement made by Sri Sanjiv Singh. However, in case, any order adversely effecting the petitioner is proposed to be passed, she should be heard before passing the order. In case, if the complaint is found to be false and after completing preliminary enquiry, consequential order may be passed in accordance with law.
