Heard learned counsel for the petitioner as well as learned Standing Counsel appearing for the respondents. With the consent of learned counsel for the parties, this writ petition is being disposed of at this stage.
The petitioner is a Clerk in the office of the respondent-College. By means of the impugned order dated 18.1.2001 the petitioner has been placed under suspension on the ground that he remained in jail for more than 48 hours. The submission of learned counsel for the petitioner is that in a criminal case pending against the petitioner the petitioner has been acquitted, vide judgment and order dated 9.5.2006 passed by the Chief Judicial Magistrate, Kushinagar, a copy of which has been filed alongwith the supplementary affidavit.
In such view of the matter, this writ petition is finally disposed of with the direction that the matter relating to the suspension of the petitioner shall be reconsidered and fresh order passed by the respondent no.3, in accordance with law, within a period of six weeks from the date of filing of a certified copy of this order before the said respondent. It is further provided that the petitioner shall be at liberty to file a representation annexing therewith all the relevant documents on which he may rely on.
With the aforesaid observations/directions, this writ petition is finally disposed of. No order as to cost.
