Against the decree in a suit under Section 176 of U.P. Zamindari Abolition and Land Reforms Act an appeal was preferred. The Additional Commissioner by his order dated 10.11.2006 allowed the appeal and has remanded the case for preparation of fresh kuras. One of the findings recorded is that there was irregularity in the service of the summons. It has also been found that the trial court did not determine the share of the appellants 3 to 6 separately and separate kuras of all the parties were not prepared. Other ground for remand have also been given. Revision against that order has been dismissed by the Board of Revenue. Good grounds for remand have been given. The petitioners will have opportunity before the trial court.
No ground for interference has been made out. Dismissed.
