Brij Nandan v. State Of U.P. And Others - WRIT - A No. 18532 of 2007 RD-AH 6676 (12 April 2007)
Hon'ble Ashok Bhushan, J.
Heard counsel for the petitioner and the learned standing counsel.
By this writ petition the petitioner has prayed for commanding the respondent to regularise the services of the petitioner as seasonal collection peon. Petitioner's case in the writ petition is that he was engaged as seasonal collection peon in the year 1985 and is working from time to time. The petitioner himself has filed order dated 29th November, 2006 in which thirty one seasonal collection peons have been mentioned who have been given regular appointment. Although the petitioner's counsel contended that certain junior seasonal collection peons have been named in the order but no relief has been claimed against the order dated 29.11.2006. The State Government has issued a Government order providing 50% of vacancy of collection peons are to be filled up from the seasonal collection peons. In view of above the petitioner is thus entitled for consideration of regular appointment as and when exercise is taken for giving regular appointment to the seasonal collection peons.
In view of above the writ petition is disposed of with the observations that as and when exercise is undertaken for filing up the post of Collection peons from the seasonal collection peons, the name of the petitioner shall be considered in accordance with his seniority and eligibility.
The writ petition is disposed of with the above observations.
