Surendra Kumar & Others v. Dy. Director Of Consolidation, Muzaffarnagar & Others - WRIT - B No. 18947 of 2007 RD-AH 6757 (12 April 2007)
Hon'ble Janardan Sahai, J
The Consolidation Officer had fixed the valuation of the plot nos. 105/1 and 106/1 as 90 paise. On the petitioner's appeal, the valuation was reduced by the Settlement Officer, Consolidation from 90 paise to 80 paise. The Deputy Director of Consolidation by his impugned order dated 20.2.2007 has restored the valuation of these numbers at 90 paise. The finding is that the valuation at 90 paise was fixed by the Consolidation Officer on the basis of spot inspection report of Chakbandi Lekhpal and taking into account the valuation of other adjoining plots in the area. The finding recorded by the Deputy Director of Consolidation is based on material. It does not suffer form any error which may call for interference under Article 226 of the Constitution. Dismissed.
