Heard Sri Aditya Prasad Mishra, learned counsel for the applicant and learned A.G.A. for the State and perused the record.
The main submission made by learned counsel for the applicant is that there is cross version of the same incident and persons on both side sustained injuries and hence, bail should be granted to the applicant, as it is not possible to decide at this stage as to which party was the aggressor.
Having heard the parties' counsel and keeping in view the fact that persons on both side have sustained injuries and there is cross version regarding the said incident without expressing any opinion on merit, the applicant may be granted bail in this case also.
Let the applicant Ummed Ali S/o Bunda involved in Case Crime No. 2147 of 2006, under Sections 326, 323, 336, 504, 506 I.P.C., P.S. Kotwali, District Muzaffar Nagar be released on bail on his executing a personal bond of Rs. 25,000/- and furnishing two sureties each in the like amount to the satisfaction of the Chief Judicial Magistrate concerned.
