We have heard Sri B.C.Rai, learned counsel for the petitioner and Sri Ranjit Saxena, counsel for the respondents.
In case the petitioner deposits a sum of Rs.25lacs with the respondent No.2 i.e. Executive Engineer, Electricity Urban Distribution Division I, Town Hall, Muzaffarnagar and file an appeal under Section 127 of the Electricity Act, 2003 within a period of one month, the same shall be decided by the respondent No.2 i.e. Executive Engineer, Electricity Urban Distribution Division I, Town Hall, Muzaffarnagar by a reasoned and speaking order after affording an opportunity to the petitioner within a period of two months thereafter.
It is provided that in case a crossed cheque of Rs.25lacs in favour of the Corporation is issued by the petitioner then the Bank will credit the aforesaid amount in favour of the Corporation from the attached account of the petitioner.
With these observations the writ petition is disposed of.
There shall be no order as to costs.
