Fahim Ahmed v. State Of U.P. & Others - CRIMINAL MISC. WRIT PETITION No. 4778 of 2007 RD-AH 6835 (16 April 2007)
Crl. Misc. Writ Petition No. 4778 of 2007
Hon'ble Sushil Harkauli, J.
Hon'ble Ajai Kumar Singh, J.
We have heard learned counsel for the petitioner.
The charge against the petitioner in the first information report is that he had a forged gun licence alleged to be issued from Nagaland. The same licence No. 5283 finds mention in the letter dated 25.2.2001 sent to the District Magistrate, Mau by the Extra Assistant Deputy Commissioner, Peren, Nagaland, in which it has been stated that the licence has been issued by that office.
Having regard to these facts mentioned in this writ petition, we dispose this writ petition finally by directing that the petitioner will not be arrested in case crime No. 646B/2006 under section 467/468/471/420/120B I.P.C., and section 25 of the Arms Act, P.S. Kopaganj district Mau, unless the Investigating Officer has reason to believe that the letter dated 25.5.2001, enclosed as Annexure 3 to this writ petition, is not a genuine letter or does not contain the correct facts and the reason for such belief is mentioned in the Case Diary by the Investigating Officer.
