Sanjay Kumar & Another v. Dy. Director Of Consolidation, Jhansi Camp At Lalitpur & Ors - WRIT - B No. 19271 of 2007 RD-AH 6880 (16 April 2007)
Hon'ble Janardan Sahai, J
This petition arises out of chak allotment of proceedings. Originally the petitioners were proposed two chaks. The chak of the petitioners was modified and instead they were allotted a single chak on plot no. 985 at the stage of Settlement Officer, Consolidation. The petitioners filed a revision which was dismissed by the Deputy Director of Consolidation by his impugned order dated 21.4.2006. It is submitted by the petitioners' counsel that original numbers of the petitioners viz., plot nos. 515, 516 and 517 which were on the road side have been taken away. The petitioners have not filed any map or document to substantiate their case. The chak which has been allotted to the petitioners at the stage of Settlement Officer Consolidation is on their original number. The finding is one of fact. The equities are well balanced. No ground for interference with the impugned order under Article 226 of the Constitution is made out. Dismissed.
