Issue notice to respondents No. 5, 6 and 7.   Learned standing counsel appears  for the respondents  No. 1 to 4.  Petitioner to take steps for service within one week.   The respondents are allowed four weeks' time to file counter affidavit.  List thereafter.

By notice dated 28.2.2007 the petitioner was informed that he shall attained the age of retirement  on 28.2.2007 after attaining the age of  58years.  Learned counsel for the petitioner  contended that  the age of superannuation is 60 years.  The petitioner having already superannuated no case is made out  for grant of interim relief.  In the event the writ petition  is allowed the petitioner shall be entitled for the benefits.
