This writ petition has been filed raising the grievance that the land of the petitioner is being taken forcibly by the respondent without resorting to any procedure prescribed by law in violation of Article 300-A of the Constitution of India.
We are of the view that the grievance of the petitioner shall be examined by the learned District Collector, Aligarh and the petitioner shall not be deprived of its valuable right in the land without following the procedure prescribed by law.
We dispose of the writ petition requesting the learned District Collector, Aligarh to ensure that the petitioner be not dispossessed from any part of his land without resorting to the procedure prescribed by law. The learned District Collector, Aligarh may pass speaking and reasoned order on a fresh representation to be filed by the petitioner, within five days from today alongwith certified copy of the order, within four weeks thereafter after hearing to the respondent nos.3 and 5.
For a period of six weeks status quo as it exists today shall be maintained regarding the possession of land.
