Heard Sri Radhey Shyam Shukla learned counsel for the applicant and learned AGA for the State and perused the papers.
The applicant is a Police Constable. He is in jail. The allegation in brief is that on the assurance of the applicant, the complainant Ram Murari Mishra whose son Anuj Mishra was kidnapped by Chandrasen, had given ransom of Rs. 5 lacs to Chandrasen, who was subsequently killed in police encounter.
It is submitted by learned counsel for the applicant that co-accused Anil @ Rajiv Kumar Sharma has been granted bail by this Court vide order dated 11.04.2007 passed in Bail Application No. 7333 of 2007, hence, the applicant should also be granted bail in this case because role of both accused is said to be identical.
On the contrary, the bail of the applicant has been opposed by the learned AGA.
Having heard learned counsel for the parties and keeping in view all the facts and circumstances, and further having regard to the fact that co-accused Anil @ Rajiv Kumar Sharma has been granted bail as mentioned above, the applicant also may be granted bail in this case now.
Let the applicant Shanker Lal S/o Kishan Lal involved in Case Crime No. 604 of 2006, under section 420 IPC, P.S. Kanth, District Shahjahanpur be released on bail on his executing a personal bond of Rs. 20000/- and furnishing two sureties each in the like amount to the satisfaction of the CJM concerned.
