Heard Sri Pankaj Kumar Srivastava and Sri Neeraj Kumar Srivastava, learned counsels for the applicant and learned AGA for the State and perused the papers.
250grms. Charas is said to have been recovered from possession of the applicant on 13.03.2007.
The main submission made by learned counsel for the applicant is that only 250 grms. Charas is said to have been recovered from his possession, which is below commercial quantity. It is also submitted that no public witness was called at the time of alleged recovery, which is said to have been made at 2.45 p.m.
On the contrary, the bail of the applicant has been opposed by the learned AGA.
Having heard learned counsel for the parties and keeping in view all the facts and circumstances, without expressing any opinion on the merit, the applicant may be granted bail in the case.
Let the applicant Vijay Pal @ Chhotu S/o Sain Kumar involved in Case Crime No. 139 of 2007, under section 18/20, NDPS Act, P.S. Baraut, District Baghpat be released on bail on his executing a personal bond of Rs. 25000/- and furnishing two sureties each in the like amount to the satisfaction of the court concerned.
