Heard the learned counsel for the petitioner Sri Vinod Sinha and the learned counsel for the respondents.
On an application made by the petitioner the electricity load has been reduced from 150 KVA to 50 KVA. On 6.4.1999 the petitioner has made an application for permanent disconnection and on the same day it was disconnected. The petitioner then made an application for refund of Rs.1,75,594/- on the ground that the excess amount has been charged from the petitioner in spite of the fact that the permanent disconnection has been made and the electric load was reduced from 150 KVA to 50 KVA. Instead of refunding the said amount, a recovery of Rs.1,01,833/- has been made against the petitioner. This order has been challenged by the petitioner in the present writ petition. An interim order has been granted by this Court.
In these circumstances we direct respondent no.2, Executive Engineer, Electricity Urban Distribution Division-II, U.P. Power Corporation ltd. Vasundhara, Ghaziabad to decide whether the petitioner is entitled for the refund of the amount claimed or there is any liability against the petitioner. The same may be decided by a reasoned and speaking order within a period of three months.
Till the decision is taken by respondent no.2, no recovery action shall be taken against the petitioner.
With the aforesaid directions the writ petition is disposed of.
