Heard Sri N.L. Pandey, learned counsel appearing for the petitioner as well as Sri V.K. Shukla, learned counsel appearing for the respondents and have perused the record.
At the outset Sri N.L. Pandey, learned counsel for the petitioner himself admitted that the petitioner has an alternative remedy under Section 117 of the Board Security Force Act, 1968 of filing an appeal against the order impugned in this writ petition.
Considering the aforesaid, since the petitioner has an alternative remedy, which has not been availed by him, I would not be inclined to interfere with the impugned order. However, in the circumstances, it is provided that in case if the petitioner files an appeal alongwith an application under Section 5, the same shall be considered by the appellate authority sympathetically, keeping in view the fact that the petitioner had been agitating his claim since long, as this writ petition had been admitted on 19.1.2001 and has remained pending till date.
Subject to the aforesaid observations, this writ petition stands dismissed. No order as to costs.
