This is an application for condoning the delay of fifteen days in filing the appeal.

We have heard Shri Rakesh Pande, learned counsel appearing for the appellant-applicant and the learned standing counsel appearing for the respondents.

Having considered the submissions made by the learned counsel for the parties, we are of the view that the delay of fifteen days in filing the appeal has satisfactorily been explained in the affidavit filed in support of the delay condonation application and the delay has not been caused on account of willful or deliberate laches on the part of the applicant. Therefore, we condone the delay.

The application is, accordingly, allowed.

Shri Rakesh Pande, learned counsel for the appellant vehemently contended that a dependant of the part time employee, who died in harness, is also entitled to be considered for giving compassionate appointment.  It is further submitted that the judgment referred in the order of the Hon'ble Single Judge is not in respect of giving compassionate appointment to the dependant of the deceased part time employee. He also informs that perhaps some special appeal involving similar issue is pending before the Lucknow Bench of this Court. He, therefore, prays for one day's accommodation to find out as to whether that appeal has been disposed of or is still pending.

As prayed, put up tomorrow.
