Heard counsel for the petitioner and the learned standing counsel.
By this writ petition the petitioner has prayed for quashing the order dated 13.12.2006 by which the petitioner has been placed under suspension with the allegation that certain irregularities were committed by preparation of memorandum of understanding regarding the affected villagers. Learned counsel for the petitioner challenging the order submitted that no misconduct was committed by the petitioner which warranted his suspension. He further contended that the petitioner was already relieved from the place in question on 9.6.2005 and he could not force the villagers to sign the memorandum of understanding. The submissions which are sought to be raised in the writ petition are initially question of fact which requires consideration by the authorities themselves. Ends of justice be served in giving liberty to the petitioner to move an application before the Director respondent No. 2 seeking revocation of the suspension order. It is observed that in case the said application is filed within two weeks from today the same may be considered and appropriate order be passed expeditiously preferably within a period of six weeks thereafter.
With the above observations the writ petition is disposed of.
