Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. During investigation the name of the applicant has been disclosed by the co-accused. There is no other evidence against the applicant. The co-accused Sonu has been released on bail by this court on 3.11.2006 in Criminal Misc. Bail Application 33558 of 2006. The case of the applicant is on the same footing with the above mentioned co-accused persons.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Shariff involved in case crime no. 163 of 2006 under Sections 147,148,149,302,307,120-B and Criminal Law Amendment Act I.P.C., P.S. Quarsi District Aligarh be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
