Om Prakash Gupta v. A.C.J. Iii (S.D.)/ Prescribed Authority And Others - WRIT - A No. 12928 of 2007 [2007] RD-AH 7307 (20 April 2007)
|
Hon'ble Rakesh Tiwari, J
Heard counsel for the parties and perused the record.
The case of the petitioner is that he is landlord of house no. 121/632 situate at Shastri Nagar, Kanpur Nagar. He filed application under Section 21(1) (A) of the U.P. Urban Buildings (Regulation of Letting, Rent and Eviction) Act, 1972 for release of the accommodation, in dispute, against the tenant- respondent no. 2. His grievance is that the release application was filed way back on 11.1.2000 but the same has not yet been decided.
At this stage, the only prayer of counsel for the petitioner is that the respondent no. 1 be directed to decide the aforesaid release application of the petitioner, within a time frame.
Standing counsel for the State has no objection to this prayer.
Delay in decision of the cases erodes the faith of public in judiciary. If cases are not decided expeditiously it may create irreparable loss and harassment to one of the parties to the dispute.
Accordingly, the writ petition is disposed of with the direction to the respondent no. 1 to decide the aforesaid release application of the petitioner by a reasoned and speaking order, in accordance with law, within a period of two months from the date of production of a certified copy of this judgment. No order as to costs.
