Learned standing counsel appearing for the respondents No. 1 to 3. Learned counsel for the petitioner submits that the impugned order dated 3.2.2007 and 23.3.2007 has been passed directing recovery of Rs.75,803/- from the petitioner's salary without giving any notice and opportunity. In paragraph 11 of the writ petition it has been specifically stated that the orders have been passed without notice. The orders being nature of recovery from the salary, the petitioner was entitled for an opportunity.
In view of above the orders dated 3.2.2007 and 23.3.2007 shall remain stayed.
List this writ petition along with writ petition No. 35125 of 2006 filed by the petitioner with regard to earlier year's recovery. Counter affidavit be filed within four weeks. List thereafter.
