Neksha v. D.D.C. - WRIT - B No. 11218 of 1985 RD-AH 7522 (24 April 2007)
Hon'ble Janardan Sahai, J.
The case was taken up in the revised list. None is present for the petitioner. It is stated in the affidavit filed in support of the abatement application that the sole petitioner Neksa died on 14.11.1999. It is stated by Sri Santosh Kumar, learned counsel for the respondents that the copy of the application was sought to be served upon the counsel for the petitioners but they refused to receive the same and an endorsement of refusal has been made on the application. The names of the counsel for the petitioner have been printed on the cause-list but they have not appeared. There is no reason to disbelieve the averments made in the affidavit of Mahraj Singh that the petitioner Neksa died on 14.11.1999.
It appears that no substitution application has been filed. The writ petition is dismissed as having abated.
