Heard counsels for the parties and perused the record.
The case of the petitioner is that he was appointed as Clerk in Janta Interimediate College, Boopbas Panchgai vide order date 2.11.1976 and he joined as such w.e.f. 3.11.1976. Vide resolution dated 21.10.1977 passed by the Committee of Management, his services were made permanent.
The petitioner was placed under suspension in November, 1990 as some criminal case appears to have been lodged against him which resulted in his acquittal vide judgment and order dated 24.7.1987 passed by IInd Addl. Munsif Magistrate, Khurza, Bulandshahr. On the representation made by the petitioner to the authorities, he was reinstated in service.
The grievance of the petitioner is that despite several representations, he has not been paid his salary from May 1990 till date.
The Standing counsel submits that since the Distict Inspector of Schools is the authority for payment of salary of the petitioner, he may be directed to decide a fresh representation which may be submitted by the petitioner,, within some time frame fixed by this Court.
Counsel for the petitioner has no objection to the above prayer.
In view of aforesaid prayer, without entering into the controversy involved between the parties, the writ petition is disposed of with the direction that if the petitioner moves a comprehensive fresh representation within 15 days from today before the respondent no. 1, he shall decide the same after affording adequate opportunity of hearing to the petitioner by a reasoned and speaking order, in accordance with law within two months from the date of production of a certified copy of this order tegether with comprehensice representation. No order as to costs.
