Roop Kunwar v. Commissioner, Moradabad Division Moradabad & Others - WRIT - C No. 20424 of 2007 RD-AH 7556 (24 April 2007)
Hon. Sunil Ambwani, J.
Heard learned counsel for the petitioner and learned Standing Counsel.
The petitioner's stay application in pending appeal against the cancellation of authorisation of sale of scheduled commodities by an exparte order has been dismissed.
I have gone through the allegations, made by the villagers against the petitioner. These allegations are specific giving material particulars, that they were not distributed scheduled commodities for several months. At this stage, the petitioner has not made out any good ground to interfere in the matter. The writ petition is disposed of with directions that the appeal may be heard expeditiously and preferably within a period of two months from the date the certified copy of the order is produced before the appellate authority. In the meantime, the respondents may make adequate alternate arrangement for distribution of scheduled commodities to the consumers with emphasis upon 'BPL', 'Antyodaya' and 'Annpurna' card holders as well as distribution of scheduled commodities under the Employment Guarantee and Mid Day Meal scheme.
