Heard counsels for the parties and perused the record.
The case of the petitioner is that he is an Assistant Teacher of the Primarh School of the Janta Inter College, Puraini Parashiya, district Deoria.
The grievance of the petitioner is that when salary was not being paid to him, he moved a representation to the District Inspector of Shools.
The Deputy Director of Education, Gorakhpur vide his letter dated 24.7.1991 recommended the case of the petitioner for payment of his salary under the Payment of Salary Act, 1971, but the District Inspector of Schools has taken a contrary view in the matter.
The grievance of the petitioner is that in view of contradicting orders the salary of the petitioner is not being paid to him.
At this stage, counsels for both the parties are agreed that the matter may be remanded back to the Director of Education, Gorakhpur Regeion, Gorakhpur for his decision and resolving the controversy.
In view of aforesaid prayer, without entering into the controversy involved in the writ petition, the writ petition is disposed of with the direction that if the petitioner moves a comprehensive representation within three weeks from today before the Director of Education, Gorakhpur Region, Gorakhpur which shall be decided by him after affording adequate opportunity of hearing to the petitioner by a reasoned and speaking order, in accordance with law within two months from the date of production of a certified copy of this order tegether with comprehensice representation. No order as to costs.
