J.K. Sugar Limited v. Prescribed Authority And Others - WRIT - C No. 73534 of 2005 [2007] RD-AH 7623 (25 April 2007)
|
Court No. 21.
Civil Misc. Writ Petition No. 73534 of 2005
J.K. Sugar Mills Ltd. ... Petitioner's
Versus
Prescribed Authority and others ... Respondents.
Hon. Sunil Ambwani, J.
Heard learned counsel for the petitioner.
A statutory appeal is provided against the impugned order under Section 17 of the Payment of Wages Act, 1936. A writ petition against the order passed by the Prescribed Authority under the Act without availing statutory remedy is not ordinarily maintainable, nor would the Court entertain the writ petition on the ground that the petitioner may have to deposit the entire amount as precondition of filing the appeal under Section 17 of the Act.
The writ petition is dismissed on the ground of statutory statutory alternative remedy of filing an appeal against the order.
