Learned standing counsel appears for the respondents No. 1 to 3. Learned counsel for the petitioners submits that the petitioners are entitled for consideration of regularisation in accordance with the statutory rules of the U.P. Regularisation of Ad hoc Appointments ( On Posts Outside the Purview of the Public Service Commission ) Rules, 1979 and the direction has also been issued by the Court to consider the regularisation of the petitioners but without there being any valid reason the regularisation has been refused. The counsel for the petitioners further submits that even the order for not regularising the petitioners has been communicated. He further submits that the employees similarly situated filed writ petition being writ petition No. 63625 of 2006 in which interim relief has been granted.
In view of above the order dated 31.3.2007 shall remain stayed. Petitioners shall be allowed to continue in the capacity on which they were functioning prior to the passing of the order dated 31.3.2007.
Let counter affidavit be filed within four weeks. Along with the counter affidavit the order dated 23.3.2007 of the Inspector General of Police as referred to in the impugned order may also be brought on the record.
