Heard learned A.G.A. for the State-appellant and perused the record.  

It is contended by learned counsel for the State that there is evidence on record to the effect that  dowry was demanded and the deceased was tortured and harassed in this regard. As a consequence, she sustained burn injuries of self-immolation. The trial Court appears to have ignored the cognizable evidence on record while  passing the order of acquittal. It requires re-consideration and re-assessment as afresh.

In above view of the matter, there is a case to grant leave to appeal. The leave to appeal is hereby granted.

Issue non-bailable warrant against the accused-respondents Rama Shanker Singh, Smt. Sushila and Manoj Singh for ensuring and securing their presence before this Court on 17th July, 2007.  In case the accused-respondents are arrested and produced before the Court of Chief Judicial Magistrate concerned and furnish  personal bonds of Rs.50,000/- and two sureties each in the like amount to the satisfaction of the Chief Judicial Magistrate concerned, they shall be released on bail.  The Chief Judicial Magistrate concerned shall submit compliance report alongwith the photostat copies of the personal bonds and surety bonds on or before the date fixed.
