Heard learned counsel for the petitioner, learned A.G.A. for the State and perused the record.
It has vehemently been argued by the learned counsel for the petitioner that the deceased Maya was pregnant. She was got admitted in the Hospital and during treatment some abnormality occurred. As a consequence, she lost her life. Her postmortem was conducted and a perusal of postmortem examination report (Annexure 4 to the Writ Petition) would not disclose the presence of any injury and the cause of her death could not be ascertained. Her vicera was kept preserved. The vicera report has not yet been obtained to disclose the cause of her death. His further contention is that the petitioner is married sister-in-law of the deceased and the allegations made against her in the impugned F.I.R. are false and concocted.
Considering the facts and circumstances of the case, let notice be issued to respondent No. 2. Two weeks' time is granted to file counter affidavit.
List on 31.01.2007.
The investigation into the case crime No. 187 of 2006 under Section 498A and 304 B.I.P.C. And ¾ D.P. Act, Police Station Panki, District Kanpur Nagar shall go on but the arrest of the petitioner shall not be effected till the date fixed, provided she co-operates with the investigation.
