Babita Devi v. State Of U.P. & Others - WRIT - C No. 20735 of 2007 RD-AH 7731 (26 April 2007)
Hon. Sunil Ambwani, J
Heard learned counsel for the petitioner and learned Standing Counsel.
The petitioner is a sitting pradhan. He has filed the writ petition against the order of the Deputy Commissioner (Food) by which he had remanded the matter, for fresh enquiry, with regard to the allegations against respondent no. 5 in the distribution of scheduled commodities. The petitioner states that the earlier enquiry report was valid and was ignored by the Commissioner.
The petitioner has not shown any prejudice caused to him. At this stage, when the Commissioner has directed the Sub Divisional Magistrate to enquire into the matter, this is not a fit case to interfere under Article 226 of the Constitution of India.
The writ petition is dismissed.
