Abatement Application No. 4064 of 1993 has been filed by the appellant supported by an affidavit mentioning therein that the land in dispute has come under the consolidation operation and the notification under Section 4 of the U.P. Consolidation of Holdings Act (hereinafter referred to as the 'Act') was published in the Gazettee on 22.12.1990. Neither any counter affidavit has been filed to the aforesaid abatement application nor the learned counsel for the respondents is present.

The Second Appeal, therefore, abates under Section 5 of the Act.
