Heard counsel for the petitioner and the learned standing counsel. By consent of parties this writ petition is being finally disposed of without inviting counter affidavit.
By this writ petition the petitioner has prayed for a writ of mandamus commanding the respondents to pay the entire amount of retiral benefits with interest. The petitioner was compulsory retired from the post of collection Amin on 31.7.2005. Petitioner's case is that although the petitioner was paid provident fund but the gratuity,insurance and leave encashment were not paid to the petitioner. Petitioner claimed to have completed all the necessary formalities but no payment of pension and gratuity has been made. Petitioner has made an application to the District Magistrate on 7.3.2007 which is said to be pending.
In view of the fact that the claim of the petitioner for payment of retiral benefit is pending, ends of justice be served in disposing of the writ petition and directing the respondent no. 2 to consider and take appropriate decision on the said application of the petitioner expeditiously preferably within a period of three months from the date of production of a certified copy of this order.
With the above observations the writ petition is disposed of.
