Heard counsel for the petitioner and the learned standing counsel.

By this writ petition  the petitioner has prayed for mandamus commanding the respondents  to pay arrears of difference of pay scale from 1.1.1986 to 31.4.2006.  Another prayer for mandamus  has been sought  in the writ petition commanding the respondents to consider and decide  the pending representation of the petitioner.  Petitioner's case is that  the petitioner retired on 31.12.2006 from the post of Sub Treasury Officer, Chaurichora, Gorakhpur.  Petitioner's case is that  the pay scales of the employees were revised  from time to time.  The petitioner's case is that although the petitioner's fixation was revised  purporting to be consequence of  Government orders  but petitioner has not been paid the arrears of salary  to which he was entitled. For the relief sought in the writ petition , the petitioner has already submitted a representation dated 16.3.2007, copy of which has been forwarded to the Additional Director of Treasuries Pension, Gorakhpur Region, Gorakhpur. Learned counsel for the petitioner submitted that that the additional Director of Treasuries  is authority competent to consider the claim of the petitioner with regard to payment of arrears.

In above view of the matter without expressing any opinion on the merits of the case ends of justice be served in disposing of the writ petition directing the respondent  No. 2  the  Additional Director of Treasuries Pension, Gorakhpur Region, Gorakhpur  to consider and  take appropriate decision on the representation of the petitioner dated 16.3.2007 expeditiously preferably within a period of three months from the date of production of a certified copy of this order.

With the above observations the writ petition  is disposed of.
