Heard Sri Sukesh Kumar, learned counsel for the applicant and learned A.G.A. for the State and perused the record.
Parity is one of the ground for bail in this case about which it is submitted by learned counsel for the applicant that the co-accused Devesh Kumar Singh @ Babloo has been granted bail by this Court vide order dated 05.04.2007 passed in bail application No. 2541 of 2007 and hence the applicant should also be granted bail in this case.
Having heard the parties' counsel and after going through the bail order mentioned above, the applicant may also be granted bail in this case because role of all the accused persons is identical.
Let the applicant Bachan Yadav S/o Shri Baij Nath Yadav involved in Case Crime No. 809 of 2006, under Sections 295-A, 413 and 414 I.P.C., P.S. Johanaganj, District Azamgarh be released on bail on his executing a personal bond of Rs. 25,000/- and furnishing two sureties each in the like amount to the satisfaction of the Chief Judicial Magistrate concerned.
