Heard Sri Amit Daga, learned counsel for the applicant and learned A.G.A. for the State and perused the record.
F.I.R. was lodged on 18.09.2006 by Smt. Sunita Handa w/o Kamal Handa and a case under Section 420/406/120-B I.P.C. was registered as case crime No. 386-BW of 2006, P.S. Sadar Bazar, District Saharanpur.
The applicant Smt. Sunita Tyagi is the wife of co-accused Sri Raj Kumar Tyagi. The main averments made in the F.I.R. are that Rs. 3 lakhs were entrusted to Sri Raj Kumar Tyagi by Smt. Sunita Handa and her husband on 07.01.2006 for opening M.I.S. Account but the said amount was misappropriated by Sri Raj Kumar Tyagi and his companions.
The main submission made by learned counsel for the applicant is that no money was entrusted to the applicant-accused Smt. Sunita Tyagi and being the wife of co-accused Raj Kumar Tyagi, she has falsely been roped in this case.
Having heard the parties' counsel and keeping in view the fact that entrustment of alleged money was made to co-accused Raj Kumar Tyagi, without expressing any opinion on merit, the applicant may be granted bail in this case.
Let the applicant Sunita Tyagi involved in Case Crime No. 386-BW of 2006, under Section 420, 406, 120-B I.P.C., P.S. Sadar Bazar, District Saharanpur be released on bail on her executing a personal bond of Rs. 25,000/- and furnishing two sureties each in the like amount to the satisfaction of the Chief Judicial Magistrate concerned.
