Heard learned counsel for the petitioner.
Apparently, the first information report under the U.P. Gangsters Act, deals with the antecedents of the accused persons including the petitioners who, according to the first information report seem to be an inter-State gang of vehicle lifters.
The stolen motor cycle was recovered from the petitioner's possession.
We do not find any such error in invoking the provisions of the Gangsters Act in the first information report, as would call for interference in the discretionary jurisdiction of this Court under Article 226 of the Constitution of India.
The writ petition is accordingly dismissed.
