Hon'ble Yatindra Singh,J.

Hon'ble R.K. Rastogi,J.

This is a writ petition for a direction to the respondents to produce  petitioner's husband, Bhoodeo.

We have heard Sri  K.K. Shangloo, learned counsel for the petitioner  and the learned  A.G.A. for the respondents.

A counter affidavit has been filed  wherein it has been indicated  that husband of the petitioner is wanted in case crime no. 431 of 2005 under sections 147, 376 and 302 I.P.C. and section 3(2) 5 of The Scheduled Castes and Scheduled Tribes ( Prevention of Atrocities ) Act police station Tappal district Aligarh and he is absconding . Hence, proceedings under sections 82 & 83 Cr.P.C. were also  initiated against him. It is further stated in the counter affidavit that  respondents have not picked up the husband of the petitioner  and in fact he is absconding and search is being made by the police itself.

In view of the above,  there is no justification to issue any direction.

The writ petition is dismissed.
