By means of this writ petition the petitioner has approached this Court for issuing a writ of mandamus directing respondents to finalize the pension and other retiral benefits of the petitioner.
An order was passed on 30.1.2004 by the respondent that the petitioner will retire from service on 30.9.2004 according to the date of birth entered in his service record. The petitioner submitted an application to the respondents for payment of retiral benefits but the same has not yet been paid. Subsequently by letter dated 5.7.2007 the Pension Directorate has been requested by respondent no.1 that all the relevant papers have been verified and the certificate issued by the School of Class 8th has also been annexed for the purpose of verification of age along with the representation of the petitioner. As such the matter relating to the pension of the petitioner may be finalized immediately.
In spite of the aforesaid fact, the petitioner has not been paid pension for which the petitioner is entitled immediately after the retirement.
In view of the aforesaid fact, the present writ petition is disposed of and a writ of mandamus is issued to the respondent no.2 to finalize the claim of the petitioner for payment of pension in accordance with the recommendation dated 5.7.2006 and pass a detailed and reasoned order according to law within a period of 2 months from the date of production of a certified copy of this order. No order as to costs.
