Heard learned counsel for the parties.
By means of this petition the petitioner has challenged the charge sheet issued by respondent-Corporation and prayed for the following relief:-
"i) Issue a writ order or direction in the nature of mandamus directing and commanding the respondents to pay all the retiral benefits including gratuity, addl. gratuity etc and also to ward penal interest @ Rs. 18% per annum.
ii) Issue a writ order or direction in the nature of certiorari quashing the two charge-sheets dated 21.1.1998 i.e. (Annexure-1 and 1A respectively to the writ petition).
iii) Issue any other suitable writ order or direction which this Hon'ble Court may deem fit and proper under the circumstances of the case.
iv) Award costs of the petition to the petitioner."
The relief in so far as it pertains to quashing of the charge sheets, we find that during the pendency of this writ petition, the disciplinary inquiry was completed and final orders of punishment were issued on 30.9.2002 and therefore, the relief no. 2, in so far as it challenges the charge sheet, has rendered infructuous by efflux of time.
So far as the relief no. 1 is concerned, we find that against the order of punishment the petitioner filed Writ Petition No. 54862 of 2002, which has been dismissed by us vide order of date. In view thereof we provide that in case after giving effect to the impugned orders of punishment, the post retiral benefits, if any, have not already been paid to the petitioner, the same shall be paid within two months' from the date of production of certified copy of this order. With these observations the writ petition stands dismissed.
Interim order, if any, stands vacated.
