We have heard Sri R.N. Rai, learned counsel for the petitioner, learned Standing Counsel appearing for respondent nos. 1, 2 and 3 and Sri Nipendra Mishra, learned counsel appearing for respondent nos. 4 and 5.
The grievance of the petitioner is that despite the letter dated 9th February, 2007 written by Additional District Magistrate, Ghazipur, the brick kiln operated by the respondent no.6 has not yet been stopped and the respondent no.6 is still continuing operation of the kiln. Sri Nipendra Mishra, learned counsel for the respondents submitted that the grievance of the petitioner may be considered by the District Magistrate, Ghazipur.
In view of the above, we dispose of the writ petition with a direction to the District Magistrate, Ghazipur to look into the grievance of the petitioner. in case, if the petitioner moves an application before the District Magistrate, Ghazipur raising its grievance, the District Magistrate, Ghazipur is directed to consider the grievance of the petitioner and take necessary against in this regard.
