Heard learned counsel for the applicant and learned A.G.A.
This application has been filed with a prayer to quash the order dated 16.1.2007 passed by Addl. Sessions Judge/F.T.C.-1, Etah in S.T. No. 470 of 2006 whereby the application under section 311 Cr.P.C. has been rejected. From the perusal of the application under section 311 Cr.P.C. and impugned orders it appears that no specific point for cross-examining the witness P.W. 2 has been given by the applicant which is essential required for just decision of the case. There is no illegality in the impugned order, therefore, the prayer for quashing the impugned order is refused..
However, it shall be open to the applicant to move an application before the court concerned under section 311 Cr.P.C., In case such application is filed, the same shall be heard and disposed of in accordance with the provisions of law.
With this direction, the application is finally disposed of.
