Heard learned counsel for the applicants and learned A.G.A.
This application has been filed with a prayer to quash the order dated 19.4.2007 passed by learned M.M.-IX, Kanpur Nagar in case No. 2499 of 2006 where by the objections filed by the applicant was rejected exparte because the counsel could not appear before the court concerned due to condolence. From the perusal of the impugned order it appears that there is no illegality in the impugned order.
However, it is directed that in case applicants deposit cost of Rs. 5,000/- within 10 days from today, the order dated 19.4.2007 can be recalled and an opportunity may be given to the learned counsel for the applicants for arguments. Thereafter applicants' prayer shall be decided. In case Rs. 5,000/- is deposited by the applicants the N.B.W. issued against the applicants shall be kept in abeyance till the disposal of the application.
With this direction, the application is finally disposed of.
