Heard learned counsel for the petitioner,  learned A.G.A. for the State and perused the record.

It is contended by the learned counsel for the petitioner that the petitioner has a valid licence to utilise the eletricity and complaint is permissible under the offence punishable under Section 135 of Electricity Act and not the FIR.

Considering the facts and circumstances of the case, issue notice to respondent no.3 to file counter affidavit within ten days.

List on 01.3.2007.

The investigation of case crime no. 62205050323 of 2006 under Section 135/138 of Electricity Act PS Banne Devi, Distt. Aligarh shall go on but the arrest of the petitioners shall not be effected till the date fixed, provided she co-operates with the investigation.
