HIGH COURT OF JUDICATURE OF ALLAHABAD

Crl. Misc. Writ Petition No. 5695 of 2007

Hon'ble Sushil Harkauli, J.

Hon'ble Vikram Nath, J.

Heard learned counsel for the petitioner.

We do not find any good reason why the petitioner should rush to this Court against a mere show cause notice in an attempt to obtain an ex parte interim order of stay instead of filing a reply to the show cause notice and contesting the matter on merits before the authority, which has issued the show cause notice. The petitioner, according to the show cause notice is involved in two cases of murder. According to the petitioner, one has resulted in acquittal and the other is still pending.

In the circumstances, we are not inclined to entertain this writ petition in our discretionary jurisdiction under Article 226 of the Constitution of India.

The writ petition is dismissed as above.
