This is the writ petition against the F.I.R./N.C.R. No. 44 of 2007 dated 15.4.2007
We have heard the counsel for the petitioner and the A.G.A. for the State.
The petitioner has been charged under section 133 of Representation of Peoples Act and under section 171 I.P.C. Both these offences are bailable. In view of this, there is no justification for quashing the First Information Report or staying the arrest of the petitioner.
However, if the petitioner surrenders and applies for bail in the aforesaid case , his application will be considered and disposed of by the Court below expeditiously taking into consideration the directions of this Court in the case of Amravati Devi Vs. State of U.P. [ 2004 (ACJ) 1846]
With the aforesaid observations writ petition is disposed of .
