Applicant Dharamveer Singh has applied for bail in this case crime no.23 of 2004 under sections 409, 420, 467, 468, 471 and 120-B, I.P.C. police station Kotwali district Ghaziabad.
Heard learned counsel for the applicant and the learned A.G.A. for the State.
The applicant was not named in the F.I.R. which was lodged against seven accused persons after making preliminary inquiry by Sri M.B.Zaidi, Addl. Zila Sahakari Adhikari, Tahsil Modinagar district Ghaziabad. It is stated that name of the applicant has come in the statement of a co-accused.
Ravi Dutta Sharma, who was named as accused No. 1 in the F.I.R., and was Secretary of the Urban Co-operative Bank Ltd. Ghaziabad has been granted bail by this Court vide order dated 8.11.2005 passed in Bail Application no. 20379 of 2005. Under these circumstances, I am of the view that the present applicant whose name does not find place in the F.I.R. and who has been implicated by a co-accused in his statement, deserves to be bailed out.
Let the applicant, Dharamveer Singh, be released on bail in the aforesaid case on his executing a personal bond and furnishing two sureties each in the like amount to the satisfaction of the court concerned.
