Heard learned counsel for the applicant and learned A.G.A.
It is contended by learned counsel fort he applicant that the applicant is accused in S.T. No. 730 of 2006 under section 147, 148, 149, 302, 307, 504, 506, 364, 392, 34 IPC pending in the court of learned Addl. Sessions Judge, Muzaffarnagar. The applicant wants to execute a sale ded in Tahsil (Sadar), district Muzaffarnagar, therefore, he may be permitted to execute the sale deed. From the same purpose the applicant has moved an application before the trial court on 26.4.2007.
Considering the fact, circumstance of the case, submissions made by learned counsel for the applicant and learned A.G.A. it is directed that in case the application is already pending before the trial court for executing the sale deed in Tahsil (Sadar), Muzaffarnagar, he shall be permitted on that day to execute a sale deed in a heavy police custody.
With this direction, the application is finally disposed of.
